Reservation Terms

Reservation details for a stay at a Bed and Breakfast at "Clos St André".

1. Information:

• Attention: You are not in gîtes, nor in bed and breakfast accommodations, nor at a hotel, you are in a Guest House.
• This contract is for the exclusive use of booking stays at the "Clos St André" bed and breakfast, 29390 SCAËR.
• The best welcome will be reserved for our guests.
• The owner commits to personally welcoming their guests with all the desired attentions to facilitate their stay.
• The reservation becomes effective once the customer has sent an advance payment of 20€ X per night X per room to "Clos St André".
• The balance is then payable upon your arrival at the "Clos St André", by bank check (French) or cash. (No card terminal on site).
• Breakfast is optional and only upon request : (Adults + 10.00 €, Children under 10 years old + 5.00 €.)

2. Reservation:

• Requests for availability or reservations, or any modifications thereof, can be made by email, mail, or phone.
• Our confirmation of availability or reservation will also be given by email, mail, or phone.
• The reservation must be made using the downloadable form available at contractleclos-1-2024.pdf, or the online form at https://www.chambres-dhotes-finistere29-bretagne.com/reserver.html, accompanied by your deposit sent by mail or online via Credit Card through PayPal "Secure Site without account opening" or PayPal.
• You cannot claim any particular room.
• We reserve the right to assign rooms based on the schedule and composition of families.
• Telephone exchanges about the availability of a reservation are purely informative.

3. Description of the stay offer: The stay offer is composed of:

• From individual or family accommodation for 2, 3, or 4 people, equipped with private toilets and shower facilities, bed and bath linens provided, TV and Wi-Fi.
• The package offer consists of inseparable products.
• Your free choice not to consume any of them during your stay cannot in any case prevail over any reduction of the price of the stay offer.
• Our rates and offers are subject to availability at the time of reservation.
• The sale of our stay offer complies with the professional and commercial rules in effect in France.

4. Length of stay:

• The present contract is granted to the tenant for tourism purposes and is of a seasonal nature.
• The customer signing this contract for a fixed term period may not under any circumstances claim any right to continued occupancy of the premises.

5. Room prices:

• The displayed rates are prices per room, per night, excluding tourist tax + 0.55€.
• Sheets and towels are provided.
• Breakfast is not included in the price. (Adults + 10.00 €, Children under 10 years old + 5.00 €.)
• The rates are differentiated based on whether the room is occupied by one, two, three, or four people, as well as the number of beds used.
• The rates do not include any possible additional services.

6. Reservation validation :

• The reservation confirmation must be made within 72H00 or it will be released for rental. (Unless otherwise agreed upon by the parties)
• Stays are guaranteed only by the receipt of the reservation form (paper or online), accompanied by a deposit whose amount corresponds to 20 € X per night(s) and X per room(s) which will be deducted from the final invoice, the balance is to be paid upon arrival at "CLOS ST ANDRE".
• In the contrary case, the Reservation will be automatically cancelled.
• No compensation or refund of any kind is owed by "LE CLOS ST ANDRE" to the Buyer who would not confirm their reservation within 72 hours.
• Note no TPE available on site for bank card payments.
• The accommodation tax of 0.55€ per night per adult is not included in the room rate.
• Advance payments are collected on the date of the stay after invoicing.
• You can pay these deposits: by bank check (French) payable to (LE CLOS ST ANDRE 29390 SCAËR), or by Credit Card on the "Clos St André" website (Secure via PayPal without account opening) or PayPal account.
• In the event of a cancellation, the client authorizes "LE CLOS ST ANDRE" to charge any outstanding deposit and the balance of the reservation according to the cancellation terms set forth in these sales conditions.
• The reservation will be definitive upon receipt of your deposit and the completed reservation form (paper or online).
• The payment of a deposit implies acceptance of the general terms and conditions of sale.
• We inform you that we are not contracted with "ANCV" and that, consequently, we cannot accept Holiday Cheques (paper or Connect).

7. Arrival time:

• The rooms are available from 3PM.
• Arrivals must be no later than 18H30.
• Thanks for letting me know about any arrival expected after 6:30 PM.

8. Departure time:

• The rooms must be vacated by no later than 10H00 on your departure day to facilitate the work of the employee who cleans and disinfects them.

9. Companion animals:

• For hygiene and safety reasons, pets are not allowed in the rooms and common areas of the "Clos St André".
• In the case of a customer leaving due to the refusal of their animal, no refund can be considered.

10. Use of locations:

• For your safety and comfort the establishment is smoke-free.
• Respecting a certain way of life is requested of all guests to ensure the tranquility of "CLOS ST ANDRE" and the comfort of its guests.
• Please do not smoke in the rooms and common areas (breakfast and lounge).
• It is forbidden to cook in the rooms as well as to do your laundry there.
• The client agrees to abide by the house rules listed in the rooms and in these general terms and conditions.
• The client agrees to return the rooms in perfect condition at the end of the stay, to report and financially assume any damage they may be responsible for on the property.
• It is strictly forbidden to use any open flame in the premises.

11. Cancellation :Cancellation or modification by the customer :

• The tenant is not entitled to a cooling-off period, in accordance with Article L121-21-8 of the Consumer Code, which applies notably to accommodation services provided on a specific date or at a fixed interval.
• The contract is therefore concluded definitively as soon as the reservation is made by the Customer.
• All cancellations must be notified by mail or email to the owner.
• In the event of cancellation by the client, they are not entitled to any compensation from Clos St André and renounce any claim of damage.

Refund of the deposit :

• Down payment made by check: Full refund by returning the check via mail or tearing up the check.
• Deposit made online by credit card or PayPal: Refund of the amount paid minus 5,00 € corresponding to the platform payment fee

If cancellation occurs:

• More than 20 days before the start of your stay, deposits are refunded with a deduction of 5 euros for processing fees.
• Less than 20 days before the start of the stay, the deposits are forfeit to Clos St André, which reserves the right to claim the balance of the accommodation fee

If cancellation occurs:

• Less than 2 days (48h00) before the start of the stay, deposits remain due to Clos St André, which reserves the right to claim the balance of the rental price if it remains vacant following cancellation.
• If the client does not contact us before 7 PM on the scheduled start day of their stay, Le Clos St André may dispose of their rooms. (Unless the client has informed the owner and a late arrival time has been agreed upon by both parties.)
• Advance payments remain due to Clos St André, which will claim and or deduct the remaining balance of the rental or stay price if the rental or stay remains vacant due to cancellation.
• In the event of a shortened stay or booking, the price corresponding to the cost of accommodation remains fully acquired by Clos St André.
• Unconsumed additional services will be reimbursed.

Cancellation or modification by the owner :

• In the event of a cancellation of a reservation by Clos St André, it undertakes to inform the customer of the cancellation of their reservation by any means and to reimburse any deposits paid by the customer.
• The customer will be refunded the amounts paid within 8 days, without being entitled to any compensation.
• The Clos St André reserves the right, if necessary, to substitute the initially reserved room with a room of the same category, in which case the cost of the reservation will remain unchanged.

12. Number of people:

• This contract is established for a specific number of persons.
• If the number of customers exceeds this total, the owner is able to refuse additional customers.
• This refusal cannot in any case be considered a modification or a breach of the contract by the owner, so in the event that the number of guests departing exceeds those who were refused, no refund can be considered.

13. Use of the internet and Wi-Fi:

• The user of the WiFi and internet access agrees not to use this access to reproduce, represent, make available, or communicate to the public works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software, and video games, without authorization.
• The user is informed that a sharing software, when connected to the internet, may automatically make downloaded files available.
• If a sharing software has been used to download protected works, it is therefore preferable to disable it.
• The user is also required to comply with the security policy defined by "Le Clos St André 29390 SCAËR" as well as the rules for using the network and computer equipment.

14. Applicable Law – Language

• These General Terms of Sale and the operations arising therefrom are governed and subject to French law.
• These General Terms and Conditions are written in the French language. In the event that they are translated into one or more foreign languages, only the French text shall prevail in case of dispute.

15. Insurance:

• The tenant is responsible for all damages occurring as a result of their actions.
• He is required to be insured by a standard vacation home insurance contract for these various risks.(ex.. Vacation home insurance.. )

16. Accommodation tax:

• The occupancy tax is a local tax that the guest must pay to the owner, who then remits it to the public treasury.

17. Safety:

• It is strictly forbidden to use any open flame in the premises.(matches, lighters, candles)

18. Right of withdrawal:

• In accordance with Article L 221-28 of the Consumer Code, the Customer does not have the right of withdrawal provided for in Article L 221-18 of the Consumer Code, taking into account the nature of the services provided.
• The contract is therefore concluded definitively upon the customer's reservation according to the terms specified in these general sales conditions.

19. Modification of sale conditions:

• These terms and conditions may be modified at any time without notice.
• Acceptance and adherence to these terms of sale are deemed acquired upon payment of the deposits.
• In accordance with the January 6, 1978 law, you have the right to access and rectify data concerning you.
